सार
The State sought cancellation of bail granted to the respondent under Section 439(2) Cr.P.C. on the ground that the gravity of the offences was not considered. HELD- Cancellation requires post-bail misconduct, violation of conditions or supervening circumstances; an earlier bail order may otherwise be set aside only if illegal or perverse. The State showed none; this Court could not sit in appeal over a Co-ordinate Bench’s order. Application dismissed.
