Petitioner sought to challenge remand to the Revenue Appellate Authority (RAA) for deciding the first appeal on merits. HELD- Where the first appellate authority has not adjudicated factual and legal issues, including limitation, parties cannot be deprived of the statutory first appeal by deciding merits at the second appellate stage. Though Section 224 of the Rajasthan Tenancy Act, 1955 confers wide powers on the Board, the appellate hierarchy cannot be bypassed. Special Appeal dismissed.
