The petitioner challenged the withdrawal of the seven-year electricity-duty exemption under the Rajasthan Solar Energy Policy, 2019. HELD- Though the State can alter or withdraw its policy in larger public interest or for fiscal requirements, it cannot take away accrued rights arising from a clear representation acted upon to the promisee’s detriment. The amendment dated 10.05.2022 operates prospectively; projects commissioned before it retain the seven-year exemption from their COD.
