Appellants challenged the dismissal of their suit under Order XI Rule 21 CPC for alleged non-compliance with an order directing production of documents. HELD – Proceedings under Order XI Rule 21(1) CPC cannot be initiated for non-compliance of an order passed under Order XI Rule 14 CPC. An order under Rule 21 requires willful default, obstinacy or contumacy in disregarding the Court's order. As these were absent, the impugned order was set aside and the suit was restored.
