The petitioners sought bail after their statements were recorded as approvers despite Section 306(4) (b) Cr.P.C. and sought to return to Bangladesh. HELD- Sec 306(4) (b) does not bar exceptional exercise of Section 482 Cr.P.C. where the approver has been examined, complied with pardon conditions, and prolonged custody with no near prospect of trial violates Article 21. Bail granted; departure remained subject to Immigration officer under the Immigration and Foreigners Act, 2025 and Order.
