सार
Petitioners challenged the use of “benefit of doubt” and “in absence of evidence” in their acquittal. HELD- Where, after full consideration of the prosecution evidence, there is no evidence against the accused and the prosecution has miserably failed to prove the charges, the accused may be described as “honorably acquitted”. The expression is not statutory. “In absence of evidence” was expunged and petitioners were ordered to stand acquitted honorably.
