सार
Section 401(2) Cr.P.C- Charges framed under Sections 7/16 of the Prevention of Adulteration Act 1954. Under Section 401(2) Cr.P.C. a right of hearing is to be provided to the accused or other person if an order is passed to their prejudice. In the instant matter no such opportunity of hearing was granted, therefore, held that provisions of Section 401(2) Cr.P.C. had not been followed.
