सार
Petitioner challenged the order directing a de novo inquiry on the same charges after the civil court decree setting aside his dismissal had attained finality. HELD- there was no order permitting reopening or initiating a fresh inquiry. The de novo inquiry was initiated after 11 years on the same charges. As the respondents failed to justify the delay or show it was attributable to the petitioner, and no order authorized a fresh inquiry, the impugned order was set aside.
