Appellant sought declaration of his 1/9th coparcenary share and cancellation of sale deeds concerning agricultural land inherited by his father under Section 8 HSA. HELD- Inheritance by the father under Section 8 does not confer a birthright on the son absent pleaded HUF/coparcenary character. The foundational khatedari right also required declaration by the competent revenue court before consequential relief. Appeal dismissed; impugned judgment affirmed.
