What is an International Commercial Arbitration? Held- An arbitration agreement can result in foreign award covered by Part-II, yet the arbitration can be arbitration other than International Commercial Arbitration. The definition given in Section 2(1) of Act of 1996 applies to whole of the Act and is not confined to Part-I. If arbitration is not an International Commercial Arbitration, the expression ‘Court’ would mean Principal Civil Court or the High Court having original civil jurisdiction.
